Arranging Service of a Witness Summons
The witness summons must be issued by the court before it can be served.
In civil proceedings, the general rule is that the summons will be served by the court unless the party requesting it confirms in writing that they wish to serve it themselves. Where the party is arranging service, a process server can be instructed to deliver the issued summons.
When serving a witness summons, the witness must be offered or paid a reasonable sum to cover travel to and from court, together with compensation for loss of time. This should be addressed before the process server attends.
