Professional Support When Serving a Bankruptcy Petition
Assist Process Serving arranges the service of bankruptcy petitions throughout England and Wales. We support solicitors, legal professionals, insolvency practitioners, creditors and individuals who need a petition served within the court timetable. Once service has taken place, Assist provides a statement of service for the instructing party’s records and potential use in proceedings.

GOV.UK states that a creditor must give the debtor a copy of the bankruptcy petition in person. If personal service cannot be achieved, the creditor can ask the court for permission to use another method of service.
Understanding Bankruptcy Petitions
A bankruptcy petition is an application to the court for an individual to be made bankrupt.
A creditor may be able to present a petition where they can show that they are owed at least £5,000, or where they share debts totalling at least £5,000 with other creditors.
Many creditor bankruptcy petitions follow an unpaid statutory demand, although this is not the only route to presenting a petition. The petition is issued by the court and must be dealt with in accordance with the applicable insolvency rules, practice direction and any directions made in the individual case.
The person against whom the petition is presented is known as the debtor. A bankruptcy petition is different from a statutory demand. A statutory demand is a formal request for payment, while a bankruptcy petition is an application to the court for a bankruptcy order.
Assist Process Serving does not provide legal, debt or insolvency advice. If you need advice about presenting, responding to or opposing a bankruptcy petition, please speak with a solicitor, licensed insolvency practitioner or suitable debt advice organisation.

Arranging Service After a Bankruptcy Petition Is Issued

Statement of Service and Relevant Documentation
Following service, Assist Process Serving provides a statement of service recording the relevant details of the attendance and service.

The precise document that needs to be filed and the relevant deadline will depend on the court, the service method and any directions in the case. If you require information in a particular format for your court filing, please tell us when you send the instruction.
