Understanding Claim Forms
A claim form is a court document used to begin civil proceedings. The person bringing the claim is known as the claimant and the person against whom the claim is brought is known as the defendant.
Claim forms can be used for a range of civil matters, including debt claims, contract disputes, property disputes and other claims for a court remedy. The relevant procedure may vary depending on the type of claim, the court and whether the case proceeds under Part 7, Part 8 or another specific Civil Procedure Rules process.
The form must be issued by the court before it is served. Where a claim form is served within England and Wales, the Civil Procedure Rules allow methods including personal service, first-class post, document exchange, leaving it at the relevant place, electronic communication where permitted and a method authorised by the court.

Arranging Service After a Claim Form Is Issued
A claim form should only be sent for service after it has been issued by the court. Check the issue date, service deadline and any court directions before making an instruction.
Where particulars of claim are served, they must be accompanied by the relevant form for defending the claim, admitting the claim and acknowledging service.
If the defendant is outside the jurisdiction, different rules apply. A claim form served outside the jurisdiction must generally be served within six months of the issue date and may require the court’s permission, depending on the circumstances.

Statement of Service and Relevant Documentation
After service has taken place, Assist Process Serving provides a statement of service recording the relevant details of attendance and service.
Where the claimant serves the claim form, the Civil Procedure Rules require a certificate of service to be filed within 21 days of service of the particulars of claim, unless all defendants have filed acknowledgements of service within that period. A claimant cannot obtain default judgment under Part 12 until the certificate of service has been filed.
