Professional Support When Serving Divorce Papers
Assist Process Serving arranges the service of divorce papers throughout England and Wales. We support solicitors, legal professionals, support organisations and individuals who need documents delivered within a required timescale. Divorce instructions can involve sensitive personal circumstances, particularly where communication between the parties has broken down or an address is uncertain. We handle each instruction discreetly and provide clear, practical updates where appropriate.

For divorce applications issued on or after 6 April 2022, the Family Procedure Rules use the terms application, applicant and respondent. A divorce petition is the earlier term used for applications issued before that date, although it is still commonly used in everyday conversation.
Understanding Divorce Papers
Divorce papers are the court documents used to begin proceedings to end a marriage.
A divorce application must be issued by the court before it is served on a respondent. When served, it must be accompanied by a form for acknowledging service and a notice of proceedings.
The court can serve divorce documents in some cases. Where solicitor service is selected, the applicant’s solicitor is responsible for arranging service in accordance with the applicable rules and any court directions.
Assist Process Serving does not provide legal advice. If you need advice about starting divorce proceedings, responding to a divorce application or petition, or resolving financial matters, please speak with a solicitor, the court or a suitable advice service.

Arranging Service After a Divorce Application Is Issued
Service arrangements should be considered once the divorce application or, in older cases, divorce petition has been issued by the court.
For a sole application, the documents for service will usually include:

The issued divorce application or divorce petition

The notice of proceedings
- 03.
The acknowledgement of service form
- 04.
Any additional application or supporting document that the court has directed should be served

Under the Family Procedure Rules, a respondent normally has 14 days from service of a divorce application to file an acknowledgement of service. The calculation can differ where documents are served outside England and Wales.

Find out more about local process serving support:
- What are divorce papers?
Divorce papers are documents used to begin a divorce case. For cases issued on or after 6 April 2022, the formal term is usually divorce application. Divorce petition is the previous term and remains common for older cases and in general use.
- Who can serve divorce papers?
The court may serve the documents, or solicitor service may be chosen. Where solicitor service applies, a solicitor or suitable third party can arrange service in accordance with the rules and any directions in the case.
- Do divorce papers need to be personally served?
Not always. The required method depends on the service arrangements, the information available, the court’s directions and the circumstances of the case. Please send the issued papers so we can review the instruction.
- What documents do I need to provide?
Please provide the issued divorce application or divorce petition, notice of proceedings, acknowledgement of service form, any additional documents that must be served, the respondent’s address and the required deadline. Include any court directions and solicitor details where relevant.
- Can you serve divorce papers the same day?
Yes. Same-day service includes a same-day first attempt. Availability depends on when we receive the instruction, the service location, the documents supplied and the required method of service.
- Will I receive proof that divorce papers have been served?
Yes. We provide a statement of service once service has taken place. The precise evidence required by the court may depend on the case and any directions made.
- Can you help if I do not know where my spouse lives?
Trace enquiries may be available at an additional cost where an address is unknown, incomplete or out of date. If attempts to locate or serve a respondent have not succeeded, an applicant may need to seek the court’s direction on alternative, deemed or dispensed service.
- Can you provide legal advice about my divorce?
No. Assist Process Serving arranges the service of legal documents but does not provide legal advice. Please speak with a solicitor, the court or a suitable advice service if you need guidance about your divorce.
